Clearing a property before probate: what executors need to consider

After someone has passed away, the Executors named in the Will are responsible for dealing with the distribution of the estate. Whilst the Executors are able to collect or clear items from a property before Probate is granted, there are some potential issues which should be considered first

• Whether any items have been specifically gifted in the Will
• Whether removing items could cause tension or disputes between family members
• Preparing a full inventory of the estate’s assets
• Clearing the property with another person present, so there is a witness if items later go missing or cannot be located
• Identifying assets of value and arranging for professional valuations where appropriate
• Confirming that valid insurance cover remains in place during the administration period

The Executors are personally responsible for ensuring the estate is dealt with properly and in accordance with the deceased’s will.
