How soon can I clear a property in an estate?

After someone passes away, the Executors named in the Will are responsible for distributing the estate.

After someone has passed away, the Executors named in the Will are responsible for dealing with the distribution of the estate.  

Whilst the Executors are able to collect or clear items from a property before Probate is granted, there are some potential issues which should be considered first.

  • Have any items in the house been specifically left to anyone
  • Will the removal of any items cause any family tensions
  • Make a full inventory of the assets 
  • Ideally clear the property with someone so that if something should go missing or can’t be found you have a witness for your defence
  • Identify any assets of value and arrange to have them valued
  • Is there valid insurance

The Executors are personally responsible for ensuring the estate is dealt with properly and in accordance with the deceased’s will.
